By: Juan Casadevall, Jorge de.
Material type: ArticleArticleOther title: The return of the fiscal portfolio reversion : nemesis of a legislative expropriation. The resounding STC 11/2024, of January 18, buried under a marmoreal slab of uncons-titutionality the most severe tax measures of the Royal Decree-law 3/2016. With the re-cent Law 7/2024, we are witnessing a tiresome tax palingenesis, the legislative némesisof a sentence adverse. The most controversial of these measures is automatic reversal of accounting impairment. Regardless of this possible unconstitutional coloration, the central thesis of this work is that we are dealing with an authentic legislative expropria-tion; an unprecedented and radically new analytical approach in our tax practice, but not unknown, by the administrative doctrine nor by our constitutional jurisprudence
