Desde el presente trabajo, partiendo de la identificación entre responsabilidad civil y deuda tributaria, se sostiene que el delito de elusión del pago de tributos tan solo reprocharía la falta de reconocimiento y pago de éstos, configurándose así, como un delito de omisión propia. Esta identificación nos permite, además, revisar el significado tradicional de fraude para este tipo delictivo, el cual ya no puede definirse ni como un elemento subjetivo específico ni como un elemento objetivo adicional del tipo que exija la utilización de artificios o engaños, con las consecuencias que tal calificación implica a efectos de la punibilidad de eventuales terceros intervinientes
In this work, taking as a starting point the conceptual identification between civil liabi-lity and the tax debt, it is argued that the avoidance of tax payments merely entails cen-sure for the failure to acknowledge and discharge the tax debt, thereby constituting an offence of pure omission. This interpretation enables a reconsideration of the traditional understanding of “fraud” in this category of offences, which cannot be equated either with a specific subjective element or with an additional objective requirement involving the use of artifice or deceit, together with the implications that such a characterisation carries for the criminal liability of any third parties who may intervene
