El trabajo somete a revisión la facultad, autoatribuida por el TC, de limitar los efectos retrospectivos de las sentencias declarativas de la inconstitucionalidad de un tributo, justificando su inadecuación a Derecho. El análisis se realiza fundamentalmente a la luz de la jurisprudencia estadounidense y de la del TJUE. Finalmente se propone el acceso al Tribunal de Estrasburgo, alegando la violación del art. 1 del Protocolo n.º 1 del Convenio Europeo de Derechos Humanos, como vía para que los contribuyentes afectados puedan obtener el reintegro de lo indebidamente ingresado, que les impide nuestro tribunal de garantías.
This article examines the Spanish Constitutional Court’s self-assumed authority to li-mit the retroactive effects of rulings that declare a tax unconstitutional, arguing that such limitations lack legal justification. The analysis is carried out primarily in the light of United States case law and the jurisprudence of the Court of Justice of the European Union. Finally, the article proposes recourse to the European Court of Human Rights, alleging a violation of Article 1 of Protocol No. 1 ECHR, as a means for affected taxpa-yers to obtain reimbursement of amounts unduly paid, which is denied to them by the Spanish Constitutional Court.
