Resumen.

La Constitución de 1978 fue pionera al incluir en su artículo 31.2 el principio de justicia en el gasto público, pero en la práctica seguimos sin dotarnos de los instrumentos necesarios para que sea efectivo. Además, en épocas de crisis las involuciones en materia de justicia son numerosas, en gran parte como consecuencia de la aplicación de las reglas que obligan a mantener el déficit estructural dentro de límites estrictos, y que no suelen ir acompañadas de esfuerzos por garantizar los derechos propios de un estado social y democrático de derecho como el nuestro. En este trabajo se reflexiona sobre esta cuestión, se incide en la insuficiente atención que le prestamos desde el Derecho Financiero y se apuntan algunas medidas adoptadas en países de nuestro entorno que inciden en la aplicación de la justicia en el gasto público y que pueden servir como punto de partida para el estudio.

The 1978 Constitution was a pioneer in including the principle of fairness in public spending in article 31.2, but in practice we still do not have the necessary instruments to make it effective. Moreover, in times of crisis, there are numerous setbacks in the area of justice, largely as a result of the application of rules that force the structural deficit to be kept within strict limits, and which are not usually accompanied by efforts to guarantee the rights inherent to a social and democratic state governed by the rule of law such as ours. This paper reflects on this issue, stresses the insufficient attention we pay to it in Financial Law and points out some measures adopted in neighbouring countries that affect the application of justice in public spending and which can serve as a starting point for the study.
