El estudio sobre los principios de derecho financiero y tributario en la Constitución Española comprende una reflexión del análisis sistemático y de los contenidos jurisprudenciales del Tribunal Constitucional y de la Sala Tercera del Tribunal Supremo, especialmente de su Sección 2ª, especializada en estos temas. Dicha valoración realiza una referencia a los principios reconocidos en el art. 31 de la CE: capacidad económica; 33, 149.1.14, 156 y 157 de la CE sobre la potestad para establecer tributos; 138, 156 y 158 de la CE sobre la solidaridad; 135 de la CE: estabilidad presupuestaria y sostenibilidad financiera y 142 de la CE: suficiencia financiera de las Corporaciones Locales. |

The present study on the principles of Finance and Tax Law in the Spanish Constitution specifically analyses both the Constitutional Court and the Supreme Court (administrative-law specialised Chamber) case-law. Particularly it examines the principle of individuals’ economic capability (article 31 of the Spanish Constitution); the power to introduce taxes (articles 33, 149.1.14, 156 & 157 of the Spanish Constitution); the principle of solidarity (articles 138, 156 & 158 of the Spanish Constitution); the principles of budgetary stability and financial sustainability (article 135 of the Spanish Constitution); and the principle of financial sufficiency of local councils (article 142 of the Spanish Constitution). |
