La aplicación del principio de responsabilidad patrimonial del legislador por infracción del Derecho de la Unión Europea se ha visto sometida en nuestro Ordenamiento Jurídico a diferentes vaivenes. El Legislador español, a través de las Leyes 39/2015 y 40/2015, reguló de forma novedosa la responsabilidad del Estado derivada de la aplicación de leyes contrarias al Derecho de la Unión Europea. La STJUE de 28 de junio de 2022 ha enjuiciado el régimen legal español, declarando las contradicciones de sus determinaciones procesales con el Derecho de la Unión desde la perspectiva del principio de efectividad. |

The application of the principle of patrimonial responsibility of the legislator for infringement of the Law of the European Union has been subjected in our Legal System to different fluctuations. The Spanish Legislator, through Laws 39/2015 and 40/2015, regulated in an innovative way the responsibility of the State derived from the application of laws contrary to the Law of the European Union. The STJUE of June 28, 2022 has prosecuted the Spanish legal regime, declaring the contradictions of its procedural determinations with Union Law from the perspective of the principle of effectiveness. |
