La doctrina viene llamando la atención sobre la deficiente regulación de la figura del responsable en la Ley General Tributaria. Las recientes modificaciones legislativas no han contribuido seguramente a mejorar esta situación, al menos si tomamos como termómetro de la salud de una institución el nivel de litigiosidad que la misma genera. Entre los múltiples problemas que presenta la aplicación de esta normativa, resulta especialmente controvertida la cuestión de los efectos interruptivos que las actuaciones realizadas cerca del deudor principal despliegan para la interrupción del plazo de prescripción de las acciones de la Administración para exigir la deuda al responsable solidario. |

Legal-scientific doctrine has called attention to the deficient regulation of the tax responsible for payment in the General Tax Law. The recent legislative modifications have certainly not helped to improve this situation, at least if we take the level of litigation that it generates as a thermometer of the health of an institution. Among the multiple problems of this regulation, the question of the interruptive effects that the actions carried out near the main debtor display for the interruption of the statute of limitations of the actions of the Administration to demand the debt from the tax jointly liable is especially controversial. |
