En este trabajo se analiza la fiscalidad de la vivienda habitual en el IRPF en la Comunidad Autónoma de Andalucía a raíz de la Ley 5/2021, de 20 de octubre. Fundamentalmente la adquisición y el arrendamiento de la vivienda habitual. Se proponen mejoras a esta norma, sobre todo para combatir la despoblación en los núcleos rurales de Andalucía. Aunque la Comunidad Autónoma de Andalucía no cuenta con demasiados municipios en riesgo de despoblación, como sí lo tienen otras Comunidades Autónomas, es necesario que se adopten medidas, entre las que son oportunas las tributarias en el IRPF, para consolidar esos pequeños municipios evitando su despoblamiento y apostando por un incremento de los servicios públicos en ellos, que permita un adecuado bienestar social a sus residentes. |

This paper analyzes the taxation of the habitual residence in the IRPF in the Autonomous Community of Andalusia as a result of Law 5/2021, of October 20. Basically the acquisition and lease of the habitual residence. Improvements to this law are proposed, especially to combat depopulation in rural Andalusia. Although the Autonomous Community of Andalusia doesn´t have too many municipalities in risk of depopulation, as other Autonomous Communities do, it is necessary to adopt measures, among which the tax measures in the IRPF are appropriate, to consolidate these small municipalities preventing the depopulation and betting for an increase of public services, which allows adequate social welfare for its residents. |
