Resumen.
La Ley de Régimen Jurídico del Sector Público, de 1 de octubre de 2015, reguló de manera novedosa la responsabilidad del Estado derivada de la aplicación de leyes contrarias al ordenamiento de la Unión. En junio de 2020, la Comisión Europea solicitó del Tribunal de Justicia de la Unión Europea la declaración de incumplimiento del Reino de España. El Abogado General emitió sus Conclusiones el 9 de diciembre de 2021, concluyendo que la regulación española vulnera el principio de efectividad. The Law on the Legal Regime of the Public Sector, of October 1, 2015, regulated in a novel way the responsibility of the State derived from the application of laws contrary to the Union order. In June 2020, the European Commission requested from the Court of Justice of the European Union the declaration of non-compliance of the Kingdom of Spain. The Attorney General issued his Conclusions on December 9, 2021, concluding that the Spanish regulation violates the principle of effectiveness.
