En junio de 2020, la Comisión Europea solicitó del Tribunal de Justicia de la Unión Europea la declaración de incumplimiento del Reino de España. El Abogado General emitió sus Conclusiones el 9 de diciembre de 2021, concluyendo que la regulación española vulnera el principio de efectividad.
